1. Scope & Provider Information

1.1. These Terms & Conditions ("T&C") govern the relationship between you (the "User") and Swift Living (run by Nicholas Gregory, self-employed in Switzerland) ("we," "us," or "our").

1.2. Swift Living is a platform accessible online at https://swiftliving.ch, enabling Users to list or find shared flats and rooms ("Services").

1.3. By creating an account or otherwise using Swift Living, you agree to these T&C. If you do not agree, you must not use Swift Living.

2. Service Description & Limitations

2.1. Listing platform. Swift Living provides a venue for Users to post or browse room/flat listings.

2.2. No real estate agency. We do not rent or manage properties ourselves, nor do we act as a party to rental or purchase agreements. All listings are the sole responsibility of the individual Users who post them.

2.3. No guarantees. We provide our Services "as is." We may modify, restrict, suspend, or discontinue any aspect of the platform at any time without notice.

3. Registration & User Accounts

3.1. Eligibility. Swift Living is intended for individuals residing in Switzerland or seeking Swiss housing. If you reside elsewhere, you may use the platform at your own discretion.

3.2. User obligations. You agree to provide accurate information when registering and to keep your login credentials secure. You are responsible for any actions taken through your account.

3.3. Account termination. You can delete your account at any time without notice. We reserve the right to suspend or delete any account if we suspect illegal or unethical use.

4. User-Posted Listings & Content

4.1. Accuracy. Users who post listings ("Advertisers") must ensure their listings are accurate, up to date, and that they have the right to offer the property.

4.2. User content. All content (e.g., text, photos, descriptions) posted by you remains your responsibility. By posting, you grant us a non-exclusive, royalty-free license to display and distribute that content on Swift Living or associated channels (e.g. social media).

4.3. Moderation rights. We may review and remove or refuse to publish any listing if we suspect it's fraudulent, outdated, or violates these T&C or applicable laws—without prior notice and without compensation.

5. Interested Parties & Communications

5.1. Responses. Users seeking properties ("Interested Parties") can respond to listings. Any subsequent rental or purchase contract is strictly between the Interested Party and the Advertiser.

5.2. No liability for messaging. Swift Living may provide messaging or other communication tools. We do not guarantee the delivery, reliability, or outcome of communications made through the platform.

6. Fees & Third-Party Services

6.1. Fees. Our basic service is currently free for individual Users. If we introduce paid features or third-party services (e.g. insurance, background checks), you will be informed, and separate terms or fees may apply.

6.2. Third-party providers. We may link to or integrate third-party offers. Contracts for those services exist solely between you and the third-party provider. We do not assume liability for external services.

7. Privacy & Data Protection

7.1. Compliance. We process personal data in accordance with Swiss data protection law (FADP) and, where applicable, the GDPR. For details, see our Privacy Policy.

7.2. Data usage. We collect information (e.g., email, listings) as necessary to operate the platform. We may use cookies or analytics (in line with Swiss/EU requirements) to improve the user experience.

7.3. User responsibilities. You are responsible for protecting any personal data you share or receive via the platform (e.g. in listing descriptions or messages).

8. Liability Disclaimer

8.1. As-is provision. Swift Living is provided "as is" without warranties of any kind. We do not warrant the accuracy, completeness, or reliability of listings, user-generated content, or any posted information.

8.2. Limitation of liability. To the extent permitted by law, we (and our vicarious agents) disclaim any liability for damages arising from use or inability to use the platform, including unauthorized account access, data loss, and fraudulent listings or responses.

8.3. User indemnification. You agree to indemnify and hold us harmless from any claims by third parties resulting from your unlawful or improper use of the platform, including any content you submit.

9. Intellectual Property

9.1. Platform rights. All intellectual property rights (design, software, trademarks, etc.) related to Swift Living remain our exclusive property or that of our licensors.

9.2. User license. We grant you a revocable, non-transferable right to access and use Swift Living for its intended purpose.

10. Amendments

10.1. Modifications. We may update these T&C at any time. We will give notice (e.g. via email or platform notification). Continued use of Swift Living after the update constitutes acceptance of the revised T&C.

10.2. Right to opt out. If you do not agree with changes, you must stop using the platform and delete your account.

11. Governing Law & Jurisdiction

11.1. Swiss law. These T&C and any disputes arising hereunder are governed by Swiss law.

11.2. Jurisdiction. The courts of Zurich shall have exclusive jurisdiction, unless otherwise required by mandatory legal provisions.
